A Lasting Power of Attorney (LPA) is a legal document that ensures your financial, medical, and personal decisions are made by people you trust if you’re ever unable to make them yourself.
There are two types

Property & Financial Affairs LPA
Allows your chosen attorneys to manage your money, bills, bank accounts, and property. It can also be used while you still have capacity if you give permission.

Health &
Welfare LPA
Allows them to make decisions about your healthcare, living arrangements, day-to-day care and medical treatment. It can only be used once you lack capacity to make the relevant decision.
Why is it important?
A Lasting Power of Attorney (LPA) gives you peace of mind that, if an accident, illness or cognitive condition means you can no longer make decisions yourself, people you know and trust can step in.
An LPA must be made while you still have mental capacity, so it is important to put one in place before it is needed.
Without an LPA, your family does not automatically have the legal authority to make these decisions for you and may need to apply to the Court of Protection instead.
If no LPAs are in place, families can encounter
Frozen bank accounts
Expensive legal fees
Inability to organise care
Added stress at an already difficult time

How we can help
We can help you understand the different types of Lasting Power of Attorney, what they cover and how they could support you and your loved ones.
Getting appropriate help can provide reassurance that you’ve thought through the important decisions and that the LPA will work as intended when your family eventually needs it.
At Kinly, we believe everyone should have access to quality estate planning.
Kinly works in partnership with estate planning experts who offer guidance tailored to your circumstances, with clear costs agreed upfront.
Many people choose to make and register an LPA themselves, including using the government’s online service (which has a £92 registration fee for each LPA). However, small mistakes such as missing signatures, signing in the wrong order, contradictory instructions or incorrectly completing the life-sustaining-treatment section can delay an application or prevent it being registered.
